School tax sides debate politics of referendum

As the Sarasota County Public Schools District prepares to hold a referendum on March 16 on the continuation of a 1-mil special tax, a number of issues have been debated in the community.

 

COPS A COP-OUT?

Certificates of participation are used for lease-purchase financing.

A certificate of participation, according to the State of Colorado’s official website, is a lease-financing mechanism through which a government body enters into an agreement to make regular lease payments for the use of an asset over some period, after which time the title for the asset transfers to the government body.

COPS have enabled the Sarasota district to undertake construction projects that the school board deemed necessary but for which it did not have full funds at the outset. Board members agreed in February 2008 to proceed with using COPS because of the savings they could realize with lower construction costs.

School tax opponents Rich Swier and Walt Augustinowicz say they believe this is not only unethical but illegal. They say that COPs are an attempt by the school district to avoid a public referendum on costly projects.

However, the Florida Supreme Court has ruled the financing method is legal. In ruling on the case of State of Florida vs. School Board of Sarasota County, the court said, "We conclude that because these obligations are not supported by the pledge of ad valorem taxation, they are not ‘payable from ad valorem taxation’ within the meaning of article VII, section 12 [of the state constitution], and referendum approval is not required."

That ruling has not changed Swier’s view. "They bypass the voters and indebted our children and grandchildren," he said. "It’s not me going to pay it. I’m going to be dead. ... They never asked me if I can indebt my children.

"The purpose is to hold government responsible," Swier continued. "We always do more for less. That’s the beauty of America. The farmer uses the same acre and grows more wheat. Intel creates a chip that provides more power with less money, but the government can’t do that"?

School board Chair Shirley Brown pointed to the high court’s decision. As far as she is concerned, Brown added, the issue is moot.

 

ILLEGAL ELECTION

If the referendum does not pass, the only cut that is certain is a 6.625-percent reduction in salaries for teachers. That is written into the collective bargaining agreement between the school board and the Sarasota Classified/Teachers Association.

Each teacher’s pay stub shows the amount that teacher would make without the extra revenue.

Brown said this is a motivational tool: "The public is paying additional taxes to help fund your salary, because the public wants an excellent education system here.

"It’s a reminder to the teachers that the public wants better. I just don’t see how that’s a negative," Brown added. "My daughter [who teaches in the district] looks at her check: ‘The taxpayers gave me extra money because they want extra work.’ It’s a sense of pride."

Augustinowicz sees this "reminder" as a means of buying votes.

"The teachers and district employees are being blackmailed," Augustinowicz said. "It was not necessary to include that in the contract. It was placed there to ensure that the union would become an army to promote the tax. … I don’t think succumbing to blackmail is an example we want to pass down to our children. Besides, I believe if an investigation is done, it would prove to be a third degree felony under section 104 of the Florida statutes."

Schools Superintendent Lori White said the notice on pay stubs is not a scare tactic. "The reality is, those dollars are potentially non-recurring. [The] collective bargaining group agreed that that makes sense," White added. "Since 2002, it has been on the paycheck ...."

The district first gained voter approval in 2002 for the 1-mil tax.

The tax opposition organization Better Schools for Less has notified Kathy Dent, Sarasota County supervisor of elections, about the pay stub notices. "We demand the school board put an end to the School’s disregard for the laws of this state," the organization’s website says.

The group also claims the district has "misleading robo-calls from school-owned systems," and flyers being sent home to parents from schools and the PALS Partners in Education organization. The group further maintains that volunteers are using school e-mail lists to send out political e-mails.

"I’d much prefer that somebody come forward and say, ‘I just don’t want to pay any taxes,’" Brown said, "not throw all these accusations out there ...."

 

THE FUTURE

The district warns of "catastrophic" changes that will have to be made if the referendum fails. Teacher salaries will be cut, jobs will be lost and the district’s current hiring freeze will continue.

"It’s hard for me to say exactly what’s going to happen if [the referendum fails]. Certainly there will be a pay cut," White said. "Highly likely that we will have to lose the [extra] 30 minutes [in the high school day], which means we have to go to a six-period day at the high school.

"That seven-period day gives students that flexibility," White pointed out. "If you fail one class, you have to try and take a virtual class or an adult high school class in the evening. ... Students want to get industry certifications or take more classes to get college credit and [losing the 30 minutes] really restricts their ability to do all that. "

White said that even with passage of the referendum, the she and the school board would be forced to make more difficult budget decisions.

Because of falling property values, the same 1-mil tax that brought in $47 million last year is expected to bring in only $38 million next year.

"Even with the extension I’ve got to cut," White said.

That situation is compounded by a projected fall in state education funding, which she said is expected to range from 2.5 percent to 5 percent.

Swier says the district would be fine if teachers were given raises based on performance and not longevity. Augustinowicz says cutting property taxes increases property values, which would only help the district.

"Voting against the referendum will send a very clear message that it’s no longer business as usual," Swier said: "‘I want you to focus on my kids. I want to make sure that my two grandchildren are educated; that they can read, write and do science at the 12th-grade level. Stop focusing on my money and start focusing on my kids.’

"By voting ‘No,’" he added, "I’m leaving money in the local economy and that may save my job and my neighbor’s job. ... I’m being expected do to more with less. Why would I not expect the school to do the same?"

"As responsible adults," Augustinowicz said, "we must teach our children to budget wisely and live within their means. We must set good examples for them. ... We should not teach them that if they want something they simply need to hold out their hand and expect it to drop into their palm."

White and Brown think a "No" vote would send a very different, harmful message.

"At a time when the competition for our graduates to get jobs is so high, now is not the time to back away from those efforts that we know are making a difference," White said.

"I think most of the business community gets it," White said. "They know having a high-quality school district creates economic viability [in] this community. You don’t have a declining school district and expect people to be attracted to move here.

"... This community has always been one that prides itself in having the highest quality," White continued, "whether it’s the schools or the arts. I think that’s why [voters] supported [the referendum] initially and why I think they will continue to do so."

Early voting for the referendum began on March 1.

I hope that means that you are teaching your kids to do as you say and not as you do since you are being so deceitful with your numbers. Shame on you, your children will know how you behaved and the lies you told for this. I saw that Walt was a leader in the Libertarian Party by doing a little research. How hypocritical of you to whine and complain to a government entity and want them to get involved and regulate people's voices. Everyone, before you vote, call the school board and ASK what they have actually spent last year and so far this year. Don't deal with budgets, deal with the real numbers of what is ACTUALLY SPENT. The truth will make you very angry with Walt and Swier for being so deceitful. I know I was.

Why does the union arm CBS and the school keep putting out their misleading numbers. That is truly shameful. You would expect more from our public school system. We wouldn't even have to put up our website www.BetterSarasotaSchools.com showing the true numbers if they would just be honest with the citizens. Why is it never mentioned that in 2000 this tax was voted down. It wasn't until they figured out that if the held a special election in March when they could use the kids and the school robo call system to deliver their one sided facts on tax payer dollars when most people would not even go to vote that it passes. Not one single time have they put it in the general election which would save half a million dollars each time. The problem is they don't want a large voter turnout that could offset the union army yes vote. COPs are a loophole that bypasses the Florida State Constitution. We always said they are technically legal. That is why we call them a loophole. But in reality they are taking out a loan in the taxpayers name without letting us vote on it which violates our constitutional right. Even the dissenting judges said it was a "sham" as they called it. We never would have voted to approved Riverview as built. It was the single most expensive school per square foot ever built in the state of Florida. The 3 schools they are builing this year cost twice as much per student station compared to the average cost for the state of Florida. They citizens of this county are done accepting the feable execuses and the pimping of our children. They will VOTE NO this Tuesday March 16th.

Real Data? I did not see on there the actual drop in actual spending that occurred this year, only budget numbers which are WAY off. I did not see you including capital campaigns and contributions and diocese support in private school tuition but yet combined capital and general operating for public schools, what a genuine comparison (that was sarcasm Walt). I did not see you include all of the POSITIVE FCAT numbers only the ONE that needed improvement. That website is deceitful and dishonest on conveying the true story. Voters, call the school board and ASK what was spent per student last year and what was spent per student on operating this year. You will be shocked and angry at the lengths Walt and Swier have gone to in order to put their names in the paper and save a few bucks at the expense of my grandchildren. INFORM YOURSELF WITH THE REAL NUMBERS!

I looked at their site and it was a real eye-opener. I think there point is that the 10th grade FCAT is the last FCAT before graduation. It doesn't really matter what happens earlier if the end product is bad does it?

I was at the Republican meeting when the topic was the school debate. Those against the tax won that debate hands down as was evidenced with 7 out of 10 members voting to fight the tax. Eric Robinson and Kathy Kleinlein didn't have much of an argument other than saying it will hurt the children. Us republicans are done with the liberal scare tactics and extorting our kids. I am voting NO on Tuesday.

It's time to stop using scare tactics and threatening that our children will suffer if we do not give the school district more money for teachers. It's an insult to all teachers when you say they will perform better in the classroom if they are given more money. You've just acknowledged there are SOME teachers who haven't been giving their ALL. That is insulting. Why do private schools pay their teachers by half and get excellent results? Don't tell me private schools are selective because they are NOT. That's an OLD worn out excuse. Teachers are just as certified and MUST produce REAL results or the school will cease to exist. It's accountability! The staff works together to solve problems for each student every day. You could simplify the explanation by saying it's a factory. No doubt, we will hear some complaint to use the word "factory," but get over it. The factory must produce a great product. If they don't, they are out of business. The public schools must produce REAL results. The students must be able to READ excellently well. That's absolutely not happening in our schools throughout the United States. That is a fact. Don't talk to me about money until you produce children who can excel in the world by themselves. The schools are not doing that. More sinister, this is about the power of unions in our schools, who want absolute control. Schools are a place for education, not politics, not manipulation, not lying and cheating. You'll get a DEFECTIVE product that way.

Time to hold government at all levels accountable, even school districts. What is interesting about this debate is the Florida legislature, Heritage Foundation, Florida Council of 100 and CATO Institute agree with Walt. We have for decades thrown more money at public education and what have our children gotten? They can't read, write or cipher at the 12th Grade level when they graduate. In Sarasota County 57% of 10th Graders are below grade level in reading and science, according to the 2009 FCAT scores. These are two critical skills to be competitive in the 21st Century. We have poured more money into this district for what? To create a bloated district salary schedule that is unsustainable. The solution - show me the major improvements in student achievement and only then will I give you more money. Leave this money in our economy and save or create jobs for the parents of public school children. Vote NO on March 16th!

Why? 2-So they do not have to take an across the board pay cut. 3-They have used the "Children, and program Cuts" as a factious issue. 4- They have mismanaged the previous budgets, just look at the operating statements available for all to see. 5-Sarasota has NOT increased its literacy ratings but have maintained a quality education for all of our children,with and without additional funding. 6-We are in a recession, no debate here, so lets begin to reign in abuse and waste. 7- Sarasota can not afford to give more,especially when they can not manage with what they have in the first place. 8-Do not be intimidated by political power or be confused by rhetoric, use common sense on March 16th. 9-We all love our children and educators, lets not confuse that either. 10-Vote with your head, and not with your heart.

They are not asking for more money, they are asking to renew the tax, which will still give them less money than in previous years because of falling property values. You Republicans just want your $10 a month back in your pocket. This is one of the top 5 school districts in the state and if you don't think this is an accomplishment then this isn't the school board's problem, its a legislative problem. Let's not punish the already underpaid profession of teaching by not voting for this tax. This district needs the money to continue to provide quality care. Let's take a poll of how many public school employees send their children to private schools or schools other than public. Have it broken down by employee position, degreed teachers with daily classroom contact with students, degreed teachers without student classroom contact, all other salary, and hourly employees. Just a thought of where they think our public schools stand.

It is time for the teachers to grow up. We are in a major economic crisis and all the teachers want is another pay raise. They have a job and only work 9 months a year and all I hear is more, more, more. Take a pay freeze and be happy you are still employed.

I have sent all four of my children to the Sarasota County Public Schools. All four have been Honor Roll students. Two have graduated and are now in college. Two are still in the system and both have 3.9 GPA's. This is due to GREAT teacher's. VOTE YES MARCH 16th!! Support our schools!!

Fred R, Are you daft? This is not a pay raise for teachers. This is to continue the tax. This is NOT an increase. If you still don't know that by now that is sad. People voting for the tax are greedy??? That makes no sense. What's greedy is crying about putting money into the school district. You have to invest money into things if you want to get something out of it. Education is no different. There may be a few democrats or moderates voting no, but the VAST majority of people who want to strip the school of its funding are republicans. The main people who continue to debate and speak out against the tax are members of the Sarasota County Republicans or write for RedCounty.com $10 a month means nothing to you and me, but that's about what each family pays with the 1-mil. With that mil, you're saving teaching jobs, salaries and school programs. If that's greedy to want to keep those things I don't know what's right.

Before the surtax, Sarasota had top schools. Without the surtax, Sarasota will have top schools. It's because we have good kids to start with from families that care! If you were to rank the test scores for the counties in Manatee, Sarasota, and Charlotte, you would find that the ranking would be inversely related the percentage of kids on the free lunch program. Let's drop the pretense that it's the pay of the teachers that determines the quality of the education. Teachers know this elementary fact, which is why they so strongly oppose any merit system based on test scores.

Sarasota County's dropout rate is 1.8%. The achievement gap has closed 16%. 84% of the schools are rated "A" by the state. We score higher than the state average on FCAT. We have extended the school day by 30 minutes. We have kids involved in Technical Career Education that prepares our students to enter the work force right away with industry certifications.

For me, it is summed up by the fact that this union of school teachers did not even blink at costing taxpayers of this county over a quarter of a million dollars for their special election. Why couldn't they wait until the regular election to have their tax placed on the ballot. Further, Florida state employees have not had a raise in four years. The teachers of this district have been getting over a 6% raise? How irresponsible. With all this extra money this teacher's union is getting from the county, it would seem that our kids would be a whole lot smarter and FCAT scores should be a whole lot higher. Vote NO to such waste. For this school union to use children to line their pockets is a disgrace. The children of Sarasota county will be just fine if this tax does not get passed. In fact, they might learn esponsible spending. That is a very good thing.

I appreciate the apparent humor of Vote Yes asking why we are against paying teachers. I suspect that Vote Yes is a teacher, and he or she thinks that I should keep paying him or her salary that exceeds the state average. Maybe the teacher would like to give me some of her money because I think my profession should pay more. Is Vote Yes willing to use the power of government to extract money from homeowners to pay my profession more money? I'd be willing to vote yes to tax Vote Yes if I got some money out of the deal too! Maybe we should just make it a voluntary tax for people that think average pay for teachers should exceed $60,000 with benefits.

No I am not a teacher as a matter of fact. I am a parent of children who attend Sarasota Public Schools. Why don't you fight to get the State funding changed so that the School District wouldn't have to go to the voters for help. I for one feel teacher's are under paid. They have one of the most important jobs in our society. Next to parents no one influences our children more. Teacher's should be valued.

The average homeowner in Sarasota County will pay roughly 75 cents a day to help keep teachers employed. If you vote no, you do not value education. 500 positions have been cut, when a teacher/administrator leaves that position is not filled. That problem will only grow if the tax does not pass.

Voting no is the fiscally responsible thing to do. They MUST LEARN to operate with less and produce, just as the rest of us are forced to do in these tough economic times, plain and simple. Educating OUR children begins in the home, something many have lost track of. The children will NOT suffer if everyone pulls their load. Stop depending on others to do the basic jobs of GOOD parents. Fiscal responsibility HAS to start throughout government or we will all end up with nothing.

If people lose their jobs due to the failure to pass this tax, it is the administration that should be held accountable. Why would an agency hire people on temporary money because this tax was never meant to be permanent. That is why it is voted on every four years. Votinig no is the right thing to do. No one in this economy, especially here in Sarasota, should be getting over 6% raises. That's nuts. And I should mention that Charlotte County pays much less per child to educate them. They do not get a tax to do that. Sarasota school unions should get their finances in order. A no vote is a good thing because it should teach these unions that they have to learn to budget their programs just like the rest of us. And don't tell me I don't care about education. I have a doctorate and education is highly important to me. It's just that tax payers did not pay for my education. I did. BTW, the teacher's union sure seems to have alot of money to advertise voting for this tax. So far, I have recieved two expensive mailings telling me to vote for it. There was also a full page ad in today's paper. Shouldn't that money had been of more use elsewhere....like education programs?

The School Board has done many things to cut costs and continues to do so. The union does support education programs. They offer college scholarships to graduating students every year. They also help collect prom dresses for girls every year. They have also collected thousands of pounds of food for families in need in Sarasota County Schools. Sarasota School Board employees also contribute thousands of dollars to the United Way. Why don't you people spend your time and energy doing a real service to the community!!

Like the earlier writer, I pay a lot for schools in my base taxes - over $6200 to be precise. But government employees always want more money, and they still want me to pay for it. I disagree that teachers have the most important job. What about the policeman, the fireman, the soldier, or the airline pilot? I guess they will all need a raise too, since they are so important. It's foolish beliefs like that that bankrupted communism. All you Democrats should start wearing the hammer and sickle emblem so we can spot you more easily. The bottom line is that an average pay of $60,000 with benefits is unconscionable. I'm certain that teachers at Temple Beth or Cardinal Mooney don't make that kind of money on average. We could get good teachers for a lot less money. Also, when the tax gets voted down, we need to get rid of the longevity pay immediately. Maybe we can eliminate some of the deadwood teachers to make room for the young, better teachers that have been hired more recently.

The only fact you need is that the average teacher makes $60,000 with benefits. My employees would love to make that kind of money -- those that still have jobs. By the way, I have three children in our public schools, and I want to have a top school system. I just hate to waste money by overpaying unionized, government employees.

let's say a teacher's average salary is $60,000 with benefits. You don't mention that out of that that same teacher must pay $700,00 a month to have health insurance for their families. Thats $8400.00 off the top. Then let's add up daycare for their children that's another $3600.00. Plus let's not forget the ones that also buy classroom supplies and bring snacks for kids that come to school hungry. Yeah I bet they are laughing all the way to the bank. Are you people for real? The average salary in Sarasota County is $37,000. The average school employee is $53,000 plus a fully paid state retirement plan and fully paid health insurance for the employee. Whay does the union want to hurt the taxpayers and their children? That taxmoney could pay for lunch for the kids if that parent didn't have to pay the tax. With 45% of the children needing help paying for their lunches it is obvious we shouldn't take the money from parents for this tax.

For the $40 million this surtax is projected to collect, out county could be building a convention center; we could be buying more beach parking; we could be buying more park lands; we could be adding sidewalks to streets. Instead, the teachers whine that an average pay of $60,000 with benefits isn't enough money for their lifestyles. So teachers would have us forget about the common good because they can't live within their comfortable means. Also, the average pay of $37000 that Walt mentions is for a year's worth of work, not the 9 months that teachers work.

I have NEVER BEEN ASKED FROM A BUYER (in forty years) ...well I'll buy the home/property (here in Sarasota County or elsewhere) IF there is a 1-mill surtax in place! Did everybody forget not to long ago, the part time SBM's made more in a base salaries then starting full time teachers! History repeats itself. When the tax referendum failed years ago, the school Board Members were voted out. It's ironic that Frank Kovach defeated Caroline Zucker after the lost referendum because she was so out of touch with the public. (She ran again and won saying she had learned her lesson, which she obviously hadn't.) They've all got to be voted out again, including Frank. We need to get some people on the school board that have the spine to stand up to the union and all the political class that attends to school board members once they get elected!

It seems to me the issue is quite staightforward. We-the folks who pay the salaries of ALL of the public employees are tightening our belts by several notches. We hope it won't be forever but it is todays reality. If it is good enough for us it is good enough for the teachers. Why not use this time of economic challenge to teach children fiscal restraint? We are in this together-solutions must come from a united front and this request for tax continuance at this time of high unemployment and low household income shows a blatant disregard for families of the school district and is the very thing that divides a community.

These attacks by those on both sides needs to stop. The people who oppose the tax have not brought up anything, but the district's budget. There is more to this vote than the budget. Losing teachers (have lost 500 already), losing the 30 minutes and possibly losing programs is not what this county needs. If you don't like the board members, fine vote them out of office next time. But don't punish the students and staff because they are rebuilding Booker and Sarasota at a heft price tag. These necessary improvements are the reason why the budget is so high.

Did you see again today expensive 4 color brochure in the mail telling us to keep arts, math, etc. With a NO vote we can keep the extra 30 minutes and don't have lose a single job. That is the problem. Those accusations are not true. Just reduce employee pay by 6.625% (they already agreed in the contract). End logevity pay and take the discretionary quarter mil. No sport, elective, extra curricular or job lost.....Vote NO problem.

Mis-informed senior. I have taken a 50% pay cut. I include the 0.25 mil because I know the school board will do it whether I like it or not. They only need a supermajority vote of the board. Do you honestly think all 5 would vote for this tax and then not take the 0.25 mil? No I didn't use false numbers. If you want just look at operating only then. Sarasota Public school just barely under $10,000 per student. Private schoold $6800. A whoping 32% less. Now tell me why debt service shouldn't be included? Schools have fund raisers all the time too. Venice Christian School doesn't even have a church associated with it. The tuition pays the mortgage. But you don't think public schools have mortgages? Debt Service expenses at our public shool just went from $19 million last year to $29 million this year (50% increase) to pay for Riverview. Think how high it will go next year with 3 new schools they are building. Guess what? Debt service will be higher than the sur-tax. Vote NO.

Private schools have capital campaigns Walt. Most religious private schools (like the majority you used) have capital campaigns, congregations contributions, AND Diocese contributions. I'm all for good schools, but the issue seems to be the pay for teachers. Can someone show me that the higher pay has resulted in better student performance? Have Sarasota's test scores gone up faster than the rest of Florida's since No Child Left Behind was passed? I'm hurting financially myself, and my tax would be several times the amount quoted above for the average tax. The people in favor of the tax talk about a lot of warm and fuzzies without getting into any facts that impact my kids. Also, I'm leery about a focus on reducing the "achievement gap". As you know, it can be done in ways other than bringing up the poor achievers. If schools are being graded on their reduction in the achievement gap, why would they want to help my white kids if it hurts their performance evaluations?

Now you're getting into hot topics! Public schools are being forced into spending all their money on kids that don't care about their education. That's what NCLB, Next Generation, and Race to the Top are all about. Someone mentioned Kansas City schools -- the courts made them spend billions of dollars on a failing school system. And they failed anyway! I'm sure the teachers in Kansas City got big pay raises when the money was flowing, and I'm sure they made all the promises that teachers are making here about creating quality schools. Why do Asian and Jewish kids excel? Should we be focusing our tax money on the top kids instead of the low achievers?

As I said yesterday, true education begins in the home with GOOD parents of all races, religions,etc. The throwing of money and abuse of it, or, the Democrat solution to end all issues will not take place here, because we the people are much smarter than that

Voters are smarter than you think Walt. You got your clock cleaned because they saw through your deceit. Voters don't like lies and bad information. You are very out of touch with reality and what the average citizen in this county cares about. Voters care about children and will not use them to prove a point, too bad you did not come to reality and see the same.

Watch out for the lawsuits to try to overturn the supermajority of the people. Tell us Rich and Walt, are Mr. Righteous and Mr. Libertarian going to turn to the courts to overturn the will of the people? Are you going to speak out against the Venice Taxpayers League for trying to impose their will on the voters of this great county or are you going to join them in using the system to try to disenfranchise the overwhelming majority of citizens in this wonderful county?

Congatulations to all the YES voters for doing their patriotic duty and voting. I. am not happy that I lost my side of the issue, but I am thrilled at the debate and the eagerness of all the GOOD people who turned out to vote. The NO voters, whom do not want children to suffer, and did vote NO for the right reasons, should not be disenchanted. I am not. If the YES and NO voters still would like to see fiscal responsibility take place we should all take to the polls and vote for the right School Board members. Again, Conratulations.

I voted "no" the last two elections. I voted "yes" this election because I found the "no" campaign to be offensive on multiple levels starting with the insults to teachers and their pay. I was one of those 6% who turned their vote yes because I saw the "us" vs. children debate offensive. I also found it offensive that the "no" campaigners were willing to be less than honest with the numbers they presented.

Enjoy the victory. Lets see how well our students do with all this money. What I find amazing is the lies told by the School Board members, and the nasty behaviour, enjoy yourselves we the people are all for children and good teachers, but to the Schoolboard members we are coming for you. Your days as our School representatives are coming to an end This November. I give you an F rating for arrogance, an F for none representation, and an F for Greed.
